Defective Product Personal Injury Settlement for $6.25+ Million

Settled a personal injury claim for $6,250,000 with the retailer and another confidential amount from the manufacturer of a defective product.

Rick Eddington helped represent a 74-year old Vietnam veteran who suffered third-degree burns to 14% of his body when his friend was refilling a decorative fire pot with liquid fuel gel. The fuel burned so clear that it looked like the flame was out when it wasn’t, and caused the flame to get into the fuel gel bottle and ignite. When it ignited, it shot burning fuel gel (much like napalm) onto the Rick’s client. The fuel gel manufacturer settled first for a confidential amount of money, and the retailer later paid $6,250,000 to settle the claim.

      Sorry for the delay in responding to your inquiry. I’m just getting over the flu for the past two weeks.

      We settled the case for an undisclosed amount of money with the fuel gel manufacturer, Bird Brain, prior to resolving the case with the retail store chain. In the settlement with the retailer their was a limited confidentiality agreement that allows us to talk about the settlement but we are not allowed to say anything that would be disparaging to the defendant.

      I can tell you that they had pulled the product off their shelves while the product was under investigation by the CPSC but then put it back on the shelves and sold the product at issue while the CPSC was still investigating the product, before it was ultimately recalled.
